1. Definitions In these terms of use: - Platform / AdvertINQ: The software service developed by Ergear Bilişim A.Ş. that enables users to plan, manage, and analyse their social media advertisements with artificial intelligence support. - User: A natural or legal person using the AdvertINQ platform. - Service: All software, artificial intelligence analytics, automation, reporting, and other digital services offered through the Platform. - Content: All data, text, visuals, videos, and similar elements created, shared, or uploaded by the User or the Company through the Platform.

2. Acceptance of Terms By accessing or registering on the AdvertINQ platform, you are deemed to have accepted these Terms of Use and the Privacy Policy. If you do not accept these terms, you should not use the Platform.

3. Scope of Service AdvertINQ executes the following processes for social media advertising campaigns through artificial intelligence-powered algorithms:

- Target audience identification,

- Budget optimisation,

- Visual and text analysis,

- Performance tracking,

- Automatic recommendation generation. Ergear Bilişim A.Ş. reserves the right to modify, update, or terminate the service without prior notice.

4. User Obligations The User:

- Agrees to use the Platform solely for lawful purposes,

- Is responsible for the security of their own social media accounts,

- Will use the analysis, recommendations and campaign management provided through the Platform as a final decision-making tool,

- Will not infringe on third parties' copyrights, trademarks or personal data.

5. Account Security The information provided during the creation of the user account must be accurate, up-to-date and complete. The user is responsible for all activities under their user account.

6. Data Use and Privacy Ergear Bilişim A.Ş. processes user data in compliance with the KVKK and GDPR. Data is used solely for the purposes of providing, improving, and ensuring the security of the service. For detailed information, please refer to the AdvertINQ Privacy Policy.

7. Intellectual Property Rights The AdvertINQ platform, its design, software, content and algorithms are wholly owned by Ergear Bilişim A.Ş. The user may not copy, reproduce, reverse engineer or commercially transfer any part of the system.

8. Pricing and Payment Some features of the platform are free, while others are paid. Pricing for paid plans is announced on the AdvertINQ website. Payments are non-refundable after service activation; they are only reviewed by Ergear Bilişim A.Ş. in cases arising from system errors.

9. Suspension or Termination of Service Ergear Bilişim A.Ş. reserves the right to suspend or terminate a user account in the following circumstances:

- Violation of these terms of use,

- Illegal or malicious use,

- Actions that jeopardise the security of the platform.

10. Disclaimer The artificial intelligence analyses and recommendations provided by AdvertINQ are based on automated predictions and modelling results. Ergear Bilişim A.Ş. cannot be held liable for any direct or indirect loss of revenue, loss of data or commercial damage arising from these recommendations.

11. Changes Ergear Bilişim A.Ş. may update these terms of use from time to time. The updated version shall enter into force when published on the Platform.

12. Applicable Law and Competent Court This agreement is governed by the laws of the Republic of Turkey. The Istanbul (Anatolia) Courts and Enforcement Offices shall have jurisdiction over any disputes that may arise between the parties.
